Pet Prospect Warranty
The dog is purebred and pedigree is correct and given at time of sale. The dog is registerable with the AKC on Limited registration papers, unless the form is withheld per written agreement. This puppy will have been examined by a veterinarian and to the best knowledge of the breeder, be in sound health and free from communicable diseases at the time of sale. The preliminary shot(s) and wormings will have been administered prior to the point of sale. The sale of any dog from Charisma Kennels is subject to the following rights and obligations by the breeder and the buyer. No warranties or guarantees expressed or implied are made under this contract except as stated below:
The seller takes no responsibility for health problems not of a hereditary nature, which develop after the time of sale, due to injury, neglect, infectious disease or other disease caused beyond the control of the seller.
This animal is warranted to be free of hereditary crippling/disabling defects apparent by 12 months of age. Determination of what constitutes a hereditary defect of a crippling or disabling nature is to be determined by the unanimous agreement of two (2) veterinarians/veterinary specialists agreeable to both parties. Cost of the treatment and subsequent expense is to be assumed by the buyer. The remedy for such defective dog is a replacement with the next available like prospect or mutually agreeable animal provided the living dog and its’ registration papers are returned to the seller.
Buyer agrees to: Annual veterinary checkups; to keep all immunizations current ; to properly administer a heartworm preventative where applicable; to provide adequate housing according to state law; to confine the animal in a fenced yard or kennel run or walk on a leash; but not to allow dog to run loose unaccompanied, nor to confine on a rope or chain.
Buyer agrees to have this animal spayed or neutered by 12 months of age. A copy of the certificate of sterilization will be sent to seller within 14 days of the procedure.
If this protocol is not followed, I understand that the warrantees expressed in this sales contract are void and are grounds for legal action against the buyer/new owner by said breeder (Charisma Kennels). Sale price is discounted for pet prospects due to spay/neuter agreement. If this agreement is broken, the remedy is a fee of $___________ to equal the price of our breeding stock net worth of $______________.
In addition to this fee the buyer agrees to pay all legal fees associated with a judgment found in favor of the seller/breeder. All legal action either taken against the buyer by the seller/breeders or taken against the seller/breeders by the buyer shall take place in Washington County, New York in accordance with New York state law.
If the buyer decides to sell or otherwise dispose of this dog, seller has the right to first refusal. If the dog is sold to another person, or AKC reg. in names other than just the buyers, all warrantees become void. Failure to comply will void all warrantees, and will constitute grounds for legal action against the buyer by the seller. Further, if said buyer dies or otherwise is unable to care for the dog, it should be returned to the seller immediately.
I, the buyer, waive my rights to a refund of the purchase price and agree to accept a replacement of equivalent value when one becomes available with no reimbursement of veterinary cost associated with the certification that the dog is unfit. I agree to return the dog to the breeder, within 48 hours of the second veterinary diagnosis that dog is found unfit with its’ AKC registration papers signed. I understand that under no circumstances are cash refunds given.
By signing this contract, I understand and agree with all of its contents.
